STANDARD TERMS AND CONDITIONS FOR THE SALE OF ARTWORK
1. Introduction: These terms and conditions (the "Terms and Conditions") apply to the sale of a Wayne H.W Wolfson Artwork to you.
2. Title and Risk: As soon as the purchase price is paid in full, you will become the legal owner of the Artwork and, upon such payment, you will be responsible for the Artwork and the risk of damage to or loss of the Artwork will pass to you.
2.1. The Buyer agrees that the sale is final and promises not to make any claims against the Seller based upon alleged express or implied representations, warranties, or collateral agreements as to the merchantability of the Artwork.
3. Copyright and Reproduction: The copyright holder reserves all reproduction rights, including the right to claim statutory copyright in the Work.
3.1. The Work may not be photographed, sketched, painted, or reproduced in any manner whatsoever without the express written consent of the copyright holder.
3.2. You may not produce any image of the Artwork and may not, at any time, publish or submit for publication or reproduction any image of the Artwork to any third party, including any internet website for any purpose.
3.3. If you breach any of your obligations under paragraph 3.1 you agree that: (a) the payment of damages will not be a sufficient remedy to compensate the Artist for your breach; (b) the Artist may apply to the court for an order to prevent you from continuing to breach your obligations under these Terms and Conditions; and (c) the Artist may contact the operator of any internet website on which the Artwork is being offered for sale or on which an image of the Artwork has been placed by you or at your direction, and instruct such operator, on your behalf, to remove any such offer for sale or image from any such internet website.
4. Certificate of Authenticity:
4.1. The Buyer will be provided a Certificate of Authenticity detailing:
• Detailed information about the medium used including the type of paint, ink, and paper used.
• Full title and the date of completion
• Dimensions
• The original signature of the artist, a copyright and reproduction rights statement, and a photograph of the work.
5. Payment Terms:
5.1. Payment is due at the time of purchase
5.2. Artwork will not be released for shipment until payment is received.
6. Shipping and Insurance:
6.1. Cost of sale includes professional packaging, shipping, and insurance.
6.2. All shipments are FOB shipping point
6.2.1. The client owns all responsibility and liability for the artwork from the moment it ships.
7. Cancellation:
7.1. Cancellations are accepted within 24 hours of purchase and will be charged a 5% fee from the total cost of sale.
8. Return Policy:
8.1. All sales are final
